General Terms and Conditions and Services of Paninicomics.co.uk website

The paninicomics.co.uk website contains a number of different services (referred to as "Services"), which are supplied by Panini S.p.A., Viale Emilio Po 380, 41126 Modena, Italy for its users. Subscription to the paninicomics.co.uk website and the use of one or more of its Services implies acceptance of the General Terms and Conditions.

Conditions for subscriptions to the Paninicomics.co.uk website and for the use of its Services
Personal data which is supplied by you when subscribing the website is used in accordance with D.Lgs. 196/2003 Italian Law (Privacy Law) and is used solely for the purposes of providing any Services on paninicomics.co.uk. It is not possible to provide a subscription without submitting personal data. By accepting the General Terms and Conditions the user declares that the personal data supplied is true and correct. If a registered user supplies Panini the personal data of another person (parents, relatives, friends, etc.) they assume full responsibility, excluding Panini from any responsibility resulting from or connected to the treatment of that data.
Panini reserves the right to suspend its Services without notice and at any time and to cancel the subscription, in particular in the following cases:
1) If the subscriber uses the website for illegal purposes or for the transmission and exchange of illicit, defamatory or abusive material, which infringes the right to privacy of other parties. The same is true if the material is of a threatening, abusive, damaging or obscene nature or violates the industrial or intellectual property rights or the rights of third parties.
2) If the subscriber uses the services for transmitting viruses, chain letters or for the (mass) distribution of material not requested via e-mail.
3) If the subscriber violates particular terms and conditions of one or more of the Services to which he is subscribed in the website.
Panini will collaborate with public authorities in the event that they ask for information or data necessary to locate persons who have engaged in illegal activities.
 
General Terms and Conditions and relating changes
The subscriber expressly authorizes Panini to send these terms and conditions, any other particular conditions and any successive changes, which constitute all the information necessary for the use of the Services, to his/her e-mail address or through links to the relevant web pages.
Panini reserves the right to change the general terms and conditions or the modalities and the availability/use of individual Services at any time and without notice.
The subscriber may check the valid terms and conditions at any time directly online via the relevant web pages of the website. The subscriber can revoke the subscription in the event that he/she does not wish to accept any new terms and conditions of the Services, according to the instructions below.
Subscription to the Paninicomics.co.uk website is not subject to a time length. The subscriber can withdraw their subscription at any time. A user’s personal account is accessed via the link marked “edit account”, such links are reserved to registered users who are logged into their account.
Continued use of the Services constitutes the subscriber's acceptance of these general terms and conditions, of any other conditions particular to specific Services and of any successive changes.
 
Access, password and security of subscriber
The subscriber may log in using their registered e-mail address and password. The subscriber is responsible for maintaining security of their password and also assumes complete responsibility for any damage caused to Panini or third parties due to non-observance of the above security.
The subscriber is therefore responsible for all activities they undertake on the Paninicomics.co.uk website and agrees that Panini bears no responsibility for any action or threat deriving from the subscriber’s use or abuse of his/her participation in the Paninicomics.co.uk website and/or its Services. The subscriber is obliged to notify Panini immediately and in writing of any possible loss of their password or of any unauthorized use of his/her user name and/or password or any other violation of security which comes to his/her attention. The subscriber can at any time change his/her password following the instructions supplied on the Paninicomics.co.uk website.
 
Function of the Paninicomics.co.uk website
The Paninicomics.co.uk website works with an automatic user recognition mechanism through a cookie that is active when the Services are used: if the subscriber has already entered their e-mail address and password to access and use one of the Services, they do not need to repeat this step when passing from one Service to another, except those Services which require an additional subscription. If the subscriber wants to inhibit this automatic recognition system they can do so at any time using the instruments at their disposal (e.g. logout, browser security settings)
 
Exclusion of guarantee
The subscriber expressly agrees that the use of the Services is at his/her own risk. The Services are supplied "as they are" and "as provided". Panini offers no guarantee that the Services correspond to the needs of the subscriber or that they are uninterrupted, secure or without error; moreover Panini offers no guarantee on the results expected, desired or obtained through the use of the Services.
 
Limitation of responsibility
Panini denies responsibility for any eventual demands made by the subscriber relating to the inability to use the Services for any reason. Panini assumes no responsibility for damages, requests or losses whether direct or indirect, caused to the subscriber due to non and/or defective function of the electronic appliances of the subscriber or third parties, including those of the Internet Service Providers, telephone and/or digital connections not installed or organised by Panini or persons under its control. Panini cannot be held responsible for damages arising from non-use of the Services because of the lack of, or mistaken function of any electronic means of communication due to circumstances beyond its control, such as natural disaster, fire, power cut, breakdown of telephone lines or of other means of network supply, malfunction of electronic appliances, even those that do not represent an integral part of the Internet network, malfunction of software installed by the subscriber, or actions of other users or persons that have access to the network.
 
Ban on resale and commercial use of the Services
The right of the subscriber to use the Services is solely personal. The subscriber can be only one person. The subscriber cannot be a juridical person, group or other organisation, even without juridical nature. The subscriber agrees not to resell these Services or use them for any commercial end.

The body entitled to store and use the personal data collected on this site is the company Panini Italia S.p.A., legally registered at Viale Emilio Po, 380, 41126 Modena, Italy.

The person in charge for the treatment of personal data is the New Media Director Giorgio Aravecchia webinfo@panini.it

The personal data is stored and used using computerised instruments and is only stored for only such time as is absolutely necessary to finalise any purposes for which it has been collected.
In order to complete any contract, the relevant personal data will be used by Panini Italia S.p.a and will also be communicated to third parties in the following categories: branches or distributors of Panini Italia S.p.a., financial institutions, transport companies, postal services and responsible government authorities.
Special safety measurements are applied in order to prevent loss of data, illicit or incorrect use of data and unauthorized access.
The authorization of the use and storage of personal data is obligatory because it is required for the execution of the contract and for the related accounting and fiscal purposes. No extra permission will be requested of the person concerned for these purposes.
With regard to the data use and storage described above the person concerned has the following rights guaranteed by art. 7 of the Law 196/2003.
 
Art. 7 - Access to personal data and other rights
1. The person concerned has the right to obtain information about the existence or non-existence of personal data regarding himself/herself, even if the data is not yet registered, and to receive such information in an understandable way.
2. The person concerned has the right to know
a) the origin of the personal data
b) the purposes and modalities of data storage and use
c) the logic applied to in case of data storage and use with the help of electronic instruments
d) the identities of holder, responsible persons and the "representative" appointed according to Art. 5, paragraph 2
e) the bodies or categories of bodies to which the personal data could be communicated or which could have access to them as representatives in certain state territories, as responsible persons or persons in charge.
 
3. The person concerned has the right:
a) to obtain an update, amendment or integration of any data
b) to ask for the cancellation of his/her data, to keep it anonymous or to block it when it is used in breach of the law. This also includes data which does not necessarily need to be conserved for the purposes for which it was gathered and treated.
c) to obtain a confirmation that the content of the above points a) and b) has been communicated to the bodies to which the data has been passed unless such communication is impossible or requiring means clearly out of proportion to the protected right.
 
4. The person concerned has the right to oppose, in total or in part:
a) the use of his/her data for legitimate reasons, even if the data is relevant for the purpose it has been gathered for.

b) the use of his/her data for the purposes of sending promotional material or direct sales, market surveys or commercial communications.
